Steve is correct that PPR is public performance rights, which is outside of a classroom.  If you are showing a film inside the classroom, that falls under 110(1) and no additional license is required.  However, 110(1) is for a showing “. . . by instructors or pupils in the course of face-to-face teaching activities of a nonprofit educational institution, in a classroom or similar place devoted to instruction . . . .”  In the CNN article below, it was a school, but the showing was for a fundraising event, which is not a teaching activity.

I have had suppliers try to charge us for an “educational license” which we simply don’t buy.  We will buy PPR licenses for films we think will be of interest to student groups and others who will be using the film for a public performance.

When I think of PPR, I think only about, well, *public* performance, not anything to do with the classroom. In the guidance I provide to our campus, the following language is used (and I realize it’s not perfect): “’Public’ refers to a group substantially larger than one’s own circle of family and friends.”

In a recent CNN article (see https://www.cnn.com/2020/02/04/us/lion-king-elementary-school-250-trnd/index.html), this distinction appears to be blurred in the view of the licensing company involved. See especially where they are reported to have stated: “Any time a movie is shown outside of the home, legal permission is needed to show it, as it is considered a Public Performance…”

Dear Colleagues,

We recently got a request from a faculty member to purchase a film
for $1000. and it was quoted as "educational pricing." I've never seen
pricing like that before. I think it was an additional $350 to add PPR.
Usually we see pricing around $350 - $695.
Has anyone else gotten a quote like this for a single film?

I'm just trying to figure out if we've been super lucky, or if the price
is as outrageous as it seems to me.
