When the conference report was received in the House, Rep. Sam Johnson (R-TX) moved to recommit HR 6 back to conference committee, insisting on the original house language on school prayer. This would have effectively killed the bill. The motion to recommit was defeated by 184 to 215, with 36 not voting on September 30. That vote was followed by a favorable vote on the conference report, 262-132, with 41 not voting (Cf., _Congressional Record_ No. 140, 9/30/94, H10407-08). Debate followed in the Senate where HR 6 was passed on October 5. Because of space limitations, only the negative votes and those not voting in the House are listed below. Also listed are the two critical ESEA votes in the Senate - one on cloture to end the filibuster and the other on passage of HR 6. If your Representative or Senator is NOT listed, they voted favorably for the legislation or did not vote; i.e.: if you do not see your representative they voted to support the ESEA reauthorization. Library supporters are strongly encouraged to thank their supporters in Congress. House/Senate conferees chose the Senate language on school prayer sponsored by Sen. Nancy Kassebaum (R-KS), which said that any violation of protected prayer would be decided in the courts, not by the Department of Education (see language in ALAWON, Vol. 3, No 55, September 30). An earlier amendment added to the bill in the Senate by Senators Robert Smith (R-NH) and Jesse Helms (R-NC) was so problematic in terms of censorship and intellectual freedom, (see _ALA WASHINGTON OFFICE NEWSLETTER_, August 17, 1994) that a large coalition, including ALA, formed in August to fight the language. ALA and many other education groups rallied their members and supporters. Grassroots support to get ESEA through has been cited as one of the main influences in its passage. The coalition included diverse groups such as People for the American Way as well as library and education groups.
