Subject: Missing & Stolen Clearinghouse Date: Sun, 28 Aug 1994 07:46:51 -0400 MISSING/STOLEN BOOKS CLEARINGHOUSE NOW AVAILABLE Every year hundreds of thousands of books, manuscripts, photographs, color plates, maps, and other rare and valuable items are stolen from museums, libraries, book shops, and private collections. Most of these are stolen only to be sold to unsuspecting collectors, dealers, and institutions. As these thefts have reached epidemic proportions, many people have expressed a desire for a central clearinghouse which would list such items in an easily searchable database and provide an easy means to contribute new items. Previously available only to subscribers, the Interloc "Missing and Stolen Books" database is now offered as a free service to the antiquarian, library and collector communities at large. Items listed have the usual bibliographical description: author, title, edition, place and date of publication, publisher, notes, and other pertinent information. The database is searchable on all fields, including submission date. Each record also lists the name, address, and phone/fax of the person, business, or institution that has submitted the item, as well as a case number for items reported to law enforcement agencies. Direct Dial Access: Interloc will provide, without charge, IBM-PC software which includes an easy-to-use database and a special telecommunications program. No one seemed to have any policies, but several people asked if they could have a look at what I compiled. At Illinois we ended up writing our own policy and procedure, which follows. Although it is specific to our organization, it does contain some elements that other libraries might want to follow, namely that it be reviewed internally to be sure the library is getting a good deal from a service perspective, and also that the institution's legal counsel have a chance to review it, to save the acquisition librarian's neck. (Thanks to Trisha Davis of Ohio State for these suggestions - she really knows this area!) Since the number of licensing agreements is increasing pretty rapidly, we are going to be looking closely at how quickly our legal counsel can turn around the documents, and we are ready to develop some additional procedures for legal review that include us a little more. University of Illinois at Urbana Licensing Agreements & Site Licenses Procedures Site licenses and licensing agreements, including those for complementary acquisitions and trial subscriptions, are documents that bind the University and the Library to certain restrictions in the use of the material which we are purchasing or using. The restrictions that companies may require can include issues of ownership, access and use. These agreements may be presented before an order can be filled, or may come with the product itself. Types of material which commonly have licensing agreements include software, CD-ROM products, and audio-visual material such as video tapes. These licensing agreements/site licenses are legal documents which require the review, approval and signature of University Legal Counsel and the University Librarian or Deputy University Librarian. To protect the Library in general as well as Acquisitions or the fund manager/selector, all such agreements must be handled in the following manner: * Send the unsigned agreement to the Library Business Office. * The Library Business Office makes 3 copies, attaches an addendum for signatures and takes the agreement to the Deputy University Librarian, who reviews the document to be sure that any restrictions do not unnecessarily inhibit service to Library users. If potential problems are apparent, they are reviewed with the University Legal Counsel. Once approved, Deputy University Librarian signs off on the agreement and the copies and signature sheet are forwarded to University Legal Counsel. * The University Legal Counsel reviews the document for potential legal problems, changes language in the document to cover questions of indemnification and other issues, and forwards the agreement to the Office of Business Affairs or The Board of Trustees. * Signed copies are returned to the Library Business Office, which is responsible for maintaining a file of approved agreements and for working with Acquisitions when necessary as they place orders for these materials. The first article, "Opportunities for Participation in ALCTS" (beginning p. 42), gives an excellent overview of the process and some suggestions for getting involved. The article also lists each committee in ALCTS followed by a brief description. The second reference occurs in the Acquisitions Section column, AS Notes by Judith Niles (beginning on p. 44). As incoming vice-chair, chair-elect, I'd like to add my encouragement to all of you who attend ALA regularly to submit a volunteer form. Throughout its brief history, the Acquisitions Section Executive Committee has relied heavily on these volunteer forms for committee appointments. Don't assume that we know everyone and their particular interests. The form can be found on p. 55 of the ALCTS Newsletter, volume 5, no. 4 or you can request a copy from Nell in the ALCTS Office, 800-545-2433 est. 5035.
